The Finance Act 2014 gave HMRC the power to request upfront payment of any disputed tax from individuals and companies that have used avoidance schemes.
The new legislation requires individuals, partnerships, companies and trusts to pay disputed amounts of tax where there is an open enquiry or appeal in an avoidance scheme.
HMRC has issued a list of ‘disclosure of tax avoidance schemes’ (DOTAS) for which it will issue an Accelerated Payment Notice (APN).
Payment will be required within 90 days and penalties and interest charges may apply to late payment.
