If you or your business is suspected of serious tax fraud, hiding money offshore or having undeclared income, HMRC may send you a letter inviting you to sign up to a Contractual Disclosure Facility (CFD). It is essential that you take specialist advice.
Under the terms of a CDF, you will have the opportunity to cooperate with HMRC over a set time period and make frank and full disclosure of any omitted tax. In return for your timely cooperation, HMRC will agree not to prosecute you.
If however, HMRC believes you are not cooperating fully or you deny any wrongdoing, it may then launch a criminal investigation.
A CDF can also be used in cases of voluntary disclosure of tax fraud or unpaid taxes.
Our tax investigation solicitors understand that going through a CDF can be a stressful and worrying time. We will quickly take control and guide you through the process as quickly and painlessly as possible.
We will prepare your disclosure report and fully address HMRC’s concerns, preventing the possibility of a criminal prosecution.
Our tax lawyers can attend meetings on your behalf and negotiate any potential penalties to achieve the best possible outcome for you.
